GENERAL TERMS AND CONDITIONS

1. SCOPE

These General Terms and Conditions shall apply to all contracts concluded between THE HEAT COMPANY Aktivwärme und Aktivkühlprodukte GmbH and Consumers (§ 13 Austrian Civil Code) in our online shop. Consumers are all individuals who conclude a legal transaction for a purpose not associated with their commercial or freelance activity.

2. CONTRACTING PARTNER, CUSTOMER SERVICE

The purchase agreement shall be concluded with THE HEAT COMPANY Aktivwärme and Aktivkühlprodukte GmbH. More information about us can be found in the impress um. 3. CONCLUSION OF CONTRACT

We shall give a binding offer for a contract conclusion for all products present in our online shop. The contract shall be concluded by accepting the offer for the goods contained in the cart through clicking the order button. Immediately after sending the order you shall receive a confirmation via e-mail.

4. SHIPPING COSTS

There are shipping costs additionally to the product prices stated. More information about the amount of the respective shipping costs can be found in the offers.

5. PAYMENT

Payment shall be made in advance, cash on delivery, by credit card, PayPal or bank transfer.

  • Payment in advance: In the case of payment in advance we shall give you our bank account number with the order confirmation and we shall deliver the goods upon receipt of payment.
  • Cash on delivery: In the case of cash on delivery additional costs in the amount of 15.60 Euro shall be paid.
  • Credit card: Your credit card shall be charged upon conclusion of the order.
  • Bank transfer: The purchase price shall be deducted from your bank account upon conclusion of the order.
  • Paypal: You pay the purchase price via PayPal. You must be registered or register first. After the verification of the access data, you can confirm your payment for us. More information will be given to you during the order.

6. Collection

We only deliver by shipment. Unfortunately, personal collection is not possible.

7. PACKING STATION

We do not deliver to packing stations.

8. RESERVATION OF TITLE

The goods shall remain our property until full payment has been made.

9. CANCELLATION POLICY

Consumers have the right to cancel their order within 14 days.

CANCELLATION RIGHT

You can cancel your order in writing (e.g. letter, fax, e-mail) within 14 days without giving reasons or, if the goods are delivered before this deadline, by sending the goods back to us. The deadline shall start upon receipt of this information in writing but not before the delivery of the goods (in the case of repeated delivery of similar goods not before the receipt of the first instalment) and also not before we have met our obligation to inform you according to art. 246 § 2 in connection with § 1, clause 1 and 2 EGBGB (Introduction to the Civil Code) as well as our obligations according to § 312g, clause 1, sent. 1 BGB in connection with art. 246 § 3 EGBGB. In order to met the cancellation deadline it shall be sufficient to send the cancellation or the goods in due time. The cancellation must be made to:

CONSEQUENCES OF CANCELLATION

In the case of a valid cancellation payments and services made on both sides and possible enjoyments (e.g. interests) must be given back. If you cannot give us back the service and enjoyment (e.g. use advantages) in full or in part or in a worse condition only, you must compensate us accordingly. You must compensate us for a worsening of the goods and enjoyments received insofar as the enjoyment or worsening can be attributed to a use of the goods which exceeds the control of characteristics and functionality. "Control of characteristics and functionality" means testing and trying the goods as possible and customary in a shop. Goods which can be dispatched in packages must be send back at our risk. You shall pay the regular costs for this return if the delivered goods are the ones ordered and of the price of the returned goods does not exceed 40 Euro or, in the case of higher prices of the goods, if you have not made yet the payment or contractually agreed partial payment at the time of cancellation. Otherwise return shall be for free. Goods which cannot be dispatched in packages are collected at your house. Obligations regarding the return of payments must be made within 30 days. The deadline starts for you with the declaration of cancellation or for us with the receipt of the goods.

10. AGREEMENT FOR PAYMENTS OF COSTS IN THE CASE OF CANCELLATION

You shall pay the regular costs for this return if the delivered goods are the ones ordered and of the price of the returned goods does not exceed 40 Euro or, in the case of higher prices of the goods, if you have not made yet the payment or contractually agreed partial payment at the time of cancellation.

11. SAVING OF CONTRACT TEXT

We shall save the contract text and send you by e-mail the order data and our general conditions. You can also read and download our general conditions on this site at any time. You can check older orders in your account on our website, if logged in.

12. CONTRACTUAL LANGUAGE

The language available for the conclusion of the contract is German.
